Terms of Sale

Article 1: Preamble
These Terms of Sale (hereinafter “Terms of Sale”) apply to any order placed with Le Marron Beer by a customer (individual or business, hereinafter “the Customer”) through the website, by telephone, or by any other available means.
Placing an order implies full and unreserved acceptance of these Terms of Sale. The Customer declares that they have read and accepted these terms prior to confirming their order.
These Terms of Sale are governed by the provisions of the Civil Code of Quebec and the Consumer Protection Act of Quebec. In the event of a conflict between these Terms of Sale and the Consumer Protection Act, the provisions of the Consumer Protection Act shall prevail for the benefit of the consumer
 
Article 2: Products
The products sold by Le Marron Beer are alcoholic beverages reserved for persons of legal drinking age, 18 years of age or older. Sale to minors is strictly prohibited. By placing an order, the Customer certifies that they are of legal drinking age and authorized to purchase alcoholic beverages in their province or territory of residence.
The essential characteristics of the products (description, formats, alcohol content) are presented on the Site. Le Marron Beer reserves the right to modify its product range without prior notice, without affecting orders already confirmed in writing.
 
Article 3: Pricing
Prices listed on the Site are expressed in Canadian dollars (CAD), before taxes. Applicable GST (5%) and QST (9.975%) are calculated and clearly displayed in the total before any final confirmation of the order, in accordance with federal and provincial tax obligations.
Shipping fees may apply depending on the Customer’s location and the volume ordered. These fees are also indicated prior to final confirmation of the order.
Prices are subject to change, provided that the price displayed at the time the Customer confirms their order is the price actually invoiced. Any price change has no effect on orders already confirmed in writing by Le Marron Beer.
 
Article 4: Placing an Order
The Customer may place an order through:

In accordance with section 54.4 of the Consumer Protection Act of Quebec, the contract of sale is only formed upon the Customer’s receipt of a written Order Confirmation from Le Marron Beer. This confirmation must specify:

• Les coordonnées complètes de Le Marron Beer
• Le délai de livraison estimé
• Les conditions d’annulation et de retour applicables
The Customer has a period of 7 days following receipt of this written Order Confirmation to cancel their order without charge or penalty, in accordance with section 54.8 of the Consumer Protection Act, provided the order was placed remotely (online or by telephone). The cancellation must be communicated in writing to Le Marron Beer via the contact form or by email.
 
Article 5: Payment
Payment is due at the time of the order or upon delivery, depending on the arrangement agreed upon. The accepted payment methods are:
• Virement Interac
• Carte de crédit (Visa, Mastercard)
• Espèces à la livraison (pour les commandes locales)
Le Marron Beer does not retain any credit card data. Card payments are processed by a PCI-DSS certified secure payment provider. No banking data is stored on Le Marron Beer’s servers.
In the event of an unauthorized transaction, the Customer is invited to immediately contact their financial institution to activate the protections provided by their card. Any payment not received within the agreed timeframe may result in the cancellation of the order, following prior notice to the Customer.
 
Article 6: Delivery
6.1 Delivery Areas
Le Marron Beer delivers to areas covered by its distribution network in Quebec (Greater Montreal, Laval, Quebec City, Gatineau, and surrounding regions). For any other location, please contact us in advance.
6.2 Delivery Timeframes
Indicative delivery timeframes are 24 to 48 hours for Greater Montreal, and 48 to 72 hours for other cities. These timeframes are provided for guidance only and do not constitute a firm contractual commitment in the event of force majeure or circumstances beyond Le Marron Beer’s control.
6.3 Receipt
Upon receipt of the order, the Customer must immediately verify the condition of the products. Any damage observed must be reported to Le Marron Beer within 48 hours of delivery, in writing, with a precise description of the damage and photographs where possible.
 
Article 7: Returns and Refunds
7.1 Legal Warranty
All products sold by Le Marron Beer benefit from the legal warranty provided under sections 37 and following of the Consumer Protection Act of Quebec. If a delivered product is defective, does not conform to its description, or is unfit for the purpose for which it is normally intended, Le Marron Beer will, at the Customer’s option:
• Au remplacement du produit défectueux sans frais supplémentaires
• Au remboursement total ou partiel du montant correspondant
• À toute autre mesure corrective prévue par la LPC
7.2 Returns
Given the perishable nature of alcoholic beverages, opened or partially consumed products cannot be returned, except in the case of a non-conformity defect duly noted at delivery and reported within the timeframe set out in Article 6.3.
7.3 Right of Resolution: Distance Contracts
For any order placed remotely (online or by telephone), the consumer Customer has a period of 7 days following receipt of the products to resolve the contract without penalty, in accordance with section 54.8 of the Consumer Protection Act of Quebec, provided the products are intact, unopened, and in resalable condition.
The Customer bears the return shipping fees unless the product is defective or non-conforming. The refund is issued within 15 days of receipt of the returned products, using the same payment method as the original order.
7.4 Claims Procedure
All claims must be submitted in writing to Le Marron Beer via the contact form at Contact Uswithin 48 hours of delivery. Le Marron Beer undertakes to acknowledge receipt within 24 hours and to provide a complete response within 5 business days..
 
Article 8: Consumer Rights
In accordance with the Consumer Protection Act of Quebec, Quebec consumers benefit from specific rights that cannot be reduced or waived by these Terms of Sale. For any questions regarding your rights, please contact:

Article 9: Force Majeure
The performance of Le Marron Beer’s obligations may be suspended in the event of a force majeure within the meaning of article 1470 of the Civil Code of Quebec (an unforeseeable, irresistible, and external event: natural disaster, strike, epidemic, governmental restriction, etc.).
The Customer will be notified in writing within 48 hours of the occurrence of the event. If the force majeure situation persists beyond 30 days, the Customer may resolve the contract and obtain a full refund of amounts paid.
 
Article 10: Disputes
In the event of a dispute, the Customer is invited to contact Le Marron Beer in the first instance for an attempt at amicable resolution via Contact Us. Le Marron Beer undertakes to respond within 10 business days.
If no amicable resolution is reached, the Parties may use the out-of-court dispute resolution mechanisms available in Quebec, in particular through theOffice de la protection du consommateur or any recognized mediation body.
These Terms of Sale do not limit the right of the consumer to bring proceedings before the court of their place of domicile, in accordance with section 11 of the Consumer Protection Act of Quebec.
 
Article 11: Governing Law
These Terms of Sale are governed by the laws of the Province of Quebec and the laws of Canada applicable therein, including in particular the Civil Code of Quebec, the Consumer Protection Act, the Excise Tax Act (GST), and the Act respecting the Québec sales tax (QST). In the event of any conflict in interpretation, the French version of these Terms of Sale shall prevail.
